By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

The Site
The Site presents fine art and photography information and may link to third-party platforms where prints, merchandise, or licensed images can be purchased or licensed. The Site itself does not process payments or fulfill orders unless we clearly say otherwise on a specific page.
Third-party sales and licensing (Fine Art America / Pixels / Shutterstock)
Prints wall art, apparel, and other merchandise offered in connection with Fortuna Art may be fulfilled through Fine Art America / Pixels or similar print-on-demand partners. Stock or licensed image use may be offered through Shutterstock or similar platforms.
If you buy or license through those platforms:
That platform’s terms, privacy policy, pricing, shipping, returns, and customer service apply to the transaction
- Fortuna Art LLCis not the checkout merchant for those third-party purchases unless the checkout page expressly says otherwise
- Product descriptions, edition status, and license scope are controlled by the listing on that platform.
Please review the third-party terms before purchasing or downloading.
Intellectual property
Unless otherwise noted, all content on the Site—including text, photographs, images, graphics, logos, layout, and compilation—is owned by Fortuna Art LLC or used under license, and is protected by U.S. and international copyright, trademark, and other laws.
You may:
View and browse the Site for personal, non-commercial use
- Share links to the Site
You may not, without our prior written permission:
Copy, download (except ordinary browser caching), reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit Site content
- Scrape, harvest, or use automated means to extract Site content at scale
- Remove copyright, trademark, or other proprietary notices
- Use Site images as stock, NFTs, training data for AI models, or merchandise without a valid license from us or from the applicable third-party platform listing
Purchasing a print or downloading a licensed file from a third-party platform does not transfer copyright in the underlying work unless that platform’s license expressly says so.

- Attempt to gain unauthorized access to the Site, related systems, or data
- Interfere with or disrupt the Site (including malware, overload, or scraping that harms performance)
- Misrepresent your identity or affiliation when contacting us
- Use the Site to send spam or unsolicited commercial messages
We may suspend or block access if we reasonably believe you have violated these Terms.

If you email us, you grant us the right to use the content of your message to respond and to operate our business. Do not send unlawful, infringing, or confidential third-party information unless you have the right to do so.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTUNA ART LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that descriptions of third-party products or licenses are complete. Artwork appearance on screen may differ from physical prints.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTUNA ART LLC AND ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.
Indemnity
You agree to defend, indemnify, and hold harmless Fortuna Art LLC and its members, managers, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.

Changes to the Site or Terms

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence apply. Exclusive venue for disputes that may be brought in court is the state or federal courts located in California, unless applicable law requires otherwise.
